TERMS AND CONDITIONS
1 Your membership starts immediately.
2 You will be entitled to all the rights and privileges exercisable for the type of membership chosen.
3 You cannot transfer this agreement to anyone else.
4 Your signature on your membership application form is your agreement to abide by these terms and conditions.
FEES AND CHARGES
5 The joining fee is due from you to us when you initially sign up for membership. Your membership fee if being paid annually is also payable upon signing up and if payment is being made monthly by Direct Debit is payable on the first Direct Debit Payment date and is not refundable other than when we are in material and continual breach of the contract.
6 The Direct Debit payment is due from you to us. For the avoidance of doubt, you are obliged to make every Direct Debit payment regardless of non attendance, whatever the reason for non attendance may be. Should you fail to make a Direct Debit Payment then the remainder of those payments will become due immediately.
7 If you fail to pay any monies due under this agreement or if any Direct Debit is returned unpaid or any cheque is returned unpaid or if any other form of payment is not honoured for whatever reason, you shall pay us on demand an administration fee of £20 due to reasonable costs incurred involved.
8 Membership fees may be increased at our discretion, subject to giving you one month’s notice and except for annual memberships which are renewed annually where an increase will only apply at the time of renewal. Any guaranteed membership rate agreements would be excluded until expiry of such guarantee periods.
9 In order to extend your membership, we will automatically continue collecting the Direct Debit payment amount each month. Your membership will be extended by one month each payment. Each payment made is non refundable under any circumstances other than where we are in material and continual breach of the contract. This renewal Direct Debit payment amount may only be amended if we advise you in writing giving 30 days notice. Please note – if your membership included the benefit of a free period then we will stop making collections during that free period and recommence making collections when this free period has finished.
10 You agree to comply with the Rules of Membership which are displayed prominently in the Club and relate to opening hours, use of facilities and your conduct. We may make reasonable changes to these Rules at any time provided we give you advance notice of the change.
11 If we take no action or let you off any breach of this agreement or give you extra time to pay or comply, it will not stop us enforcing the terms of this agreement strictly at a future date.
12 We may assign the benefit of this agreement and our rights there under to a third party on notice to you.
13 Your rights under this agreement will not be prejudiced.
14 This agreement is governed by legal jurisdiction under Scottish Law.
15 We may terminate this agreement with immediate effect with no notice to you if you are in breach of the Club rules. In this event you will not be liable to pay any further Debit payments provided such breach is not deemed by us to have occurred primarily in order to qualify for a refund.
16 If you are dissatisfied with the service offered by MM Fitness for any reason within the first 10 days of becoming a member, you are entitled to a refund of any membership fees paid subject to notification in writing to us within the 10 day period. Validated refunds will be paid within 28 days from receipt of the letter. All start up fees (joining fee) will be retained in order to meet the reasonable costs incurred in processing the membership application and your induction to the club.
17 If you wish to cancel your membership, you should make and attend an appointment with the Club Manager. You should sign a Departure Request Form which will be countersigned by the manager. If you are unable to attend you must write to the Club Manager. We recommend you send your letter by recorded delivery to ensure notice of cancellation is received. Telephone cancellations will not be accepted.
18 We are entitled to retain any memberships fees where you have not cancelled your Direct Debit instruction with your bank and you have not advised MM Fitness of your cancellation (see 16 above).
19 Members may bring up to 2 guests at any one time at a cost of £10.00 per guest. The member must accompany their guests at all times and sign them in immediately upon entering MM Fitness. All members and guest must comply with Club rules at all times. Members are responsible for the actions and behaviour of their guests.
